Welcome to WikiYou. These Terms of Service ("Terms") govern your access to and use of the website located at https://wikiyou.org (the "Site"), operated by WikiYou ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

1. Acceptance of Terms
By accessing, browsing, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference. If you are using the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include that organization.
2. Description of Service
WikiYou is a free, community-built encyclopedia powered by GitHub. The Site provides informational content including articles, profiles, interactive tools, browser-based games, and other educational and entertainment materials (collectively, "Content"). The Site is provided on an "as is" and "as available" basis.
3. User Conduct
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is hosted, or any server, computer, or database connected to the Site.
- Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission, except for standard search engine indexing.
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm us or users of the Site or expose them to liability.
- Impersonate or attempt to impersonate WikiYou, a WikiYou contributor, or any other person or entity.
- Use the Site to transmit or procure the sending of any advertising, promotional material, spam, or any other form of unsolicited communication.
4. User Contributions
4.1 Submission of Contributions
WikiYou allows users to contribute Content through GitHub Pull Requests. By submitting a contribution to the WikiYou repository, you acknowledge and agree to the following:
4.2 License Grant
By submitting Content to WikiYou, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content in any media or distribution method now known or hereafter developed, in connection with the Site and its operations. This license survives any termination of these Terms.
4.3 Representations and Warranties
By submitting Content, you represent and warrant that:
- You are the original author of the Content or have obtained all necessary rights, licenses, consents, and permissions to submit the Content and grant the license described above.
- The Content does not infringe, misappropriate, or otherwise violate any third party's intellectual property rights, privacy rights, publicity rights, or any other legal rights.
- The Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
- The Content does not contain any false, misleading, or deceptive statements or information.
- The Content does not promote illegal activity or advocate, promote, or assist any unlawful act.
- The Content is not designed to deceive, mislead, or defraud any person.
- The Content complies with all applicable laws and regulations.
4.4 Content Review and Removal
We reserve the right, but are not obligated, to review, edit, refuse, or remove any Content at our sole discretion and without notice, for any reason or no reason, including but not limited to Content that we determine, in our sole judgment, violates these Terms, is objectionable, or may expose WikiYou or its users to harm or liability. We do not undertake to monitor all Content submitted to or published on the Site.
4.5 No Compensation
You acknowledge and agree that you will not receive any compensation, credit, or consideration of any kind for any Content you submit to WikiYou, except as may be separately agreed upon in writing.
5. Intellectual Property
5.1 Site Content
The Site's design, layout, code, and functionality (excluding user-contributed Content) are owned by WikiYou and are protected by applicable intellectual property laws. The WikiYou name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of WikiYou or its affiliates. You must not use such marks without our prior written permission.
5.2 Open Source
WikiYou's source code is available on GitHub and is subject to the applicable open source license as specified in the repository. Your use of the source code is governed by the terms of that license.
5.3 Copyright Infringement
If you believe that any Content on the Site infringes your copyright, please notify us by submitting a notice through our GitHub Issues page or by contacting us as set forth in Section 15. Your notice should include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with sufficient information to locate it on the Site.
- Your contact information, including address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
6. Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PRODUCTS AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.
Without limiting the foregoing, we do not represent or warrant that:
- The Site will be available, uninterrupted, timely, secure, or error-free.
- The results that may be obtained from the use of the Site will be accurate, reliable, or complete.
- The quality of any Content, products, services, information, or other material obtained through the Site will meet your expectations.
- Any errors on the Site will be corrected.
Any Content downloaded from or otherwise accessed through the Site is accessed at your own risk, and you shall be solely responsible for any damage to your property (including your computer system and mobile device) or loss of data that results from the download or use of any such Content.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WIKIYOU, ITS OWNERS, OPERATORS, CONTRIBUTORS, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH:
- Your access to, use of, or inability to access or use the Site.
- Any conduct or Content of any third party on the Site.
- Any Content obtained from the Site.
- Unauthorized access, use, or alteration of your transmissions or Content.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (USD $100.00).

8. Indemnification
You agree to defend, indemnify, and hold harmless WikiYou, its owners, operators, contributors, affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys' fees) arising from or related to:
- Your use of and access to the Site.
- Your violation of any provision of these Terms.
- Your violation of any rights of a third party, including but not limited to intellectual property rights, privacy rights, or publicity rights.
- Any Content you submit to or through the Site.
- Your willful misconduct.
This indemnification obligation will survive the termination of these Terms and your use of the Site.
9. Third-Party Links
The Site may contain links to third-party websites and services that are not owned or controlled by WikiYou. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that WikiYou shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites or services.
10. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
11. Governing Law & Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. You irrevocably submit to the exclusive jurisdiction of the courts located in the State of California for the resolution of any dispute arising from these Terms or your use of the Site.
11.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts as set forth above.
11.3 Waiver of Class Action
YOU AND WIKIYOU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless both you and WikiYou agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
12. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent to the greatest extent possible.
13. Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting the updated Terms on this page, with the "Last Updated" date revised accordingly. Your continued use of the Site after any modification to these Terms constitutes your binding acceptance of the modified Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified Terms, you must discontinue your use of the Site.
14. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices or policies published by us on the Site, constitute the entire agreement between you and WikiYou regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
